I agree with you pappu... That's the point i was trying to make as well.
If this information exists in their system, and if all IO's make it transparent to the caller in the first call itself, i am sure the call volume will drop to atleast one tenth of what it is currently... and subsequently, the congressman requests, ombudsman requests will also reduce which inturn WOULD MEAN THAT THEY GET TO FOCUS MORE ON THE CASES AND IMPROVE THEIR PRODUCTIVITY AS WELL AS COMPETENCE!!!

Hi ,
My priority date is March 26th 2006 and current for month of September.
I created a SR on 09/14 and got the following response today.
"
Service records indicate that your application is pending and waiting assignment to an officer. You will be notified when a decision has been made or if additional information is needed. If you do not receive a decision or other notice of action from us within 60 days from the date of this letter, please contact customer service to complete another service request
"
I would appreciate if someone can interpret the message.

This is good but the numbers are very less to do anything in the bigger picture(EB2+EB3 pending). Atleast something is better than nothing.
Hope this doesn't lead to laxing on the advocacy day agenda or less efforts from EB2 people on the verge. EB3 people stuck wtih pre -perm labor, no substitution should also be helped, and way to do it , recapture of unused numbers, hold on diversity lottery. Going through advocacy efforts. A united effort has a higher chance.
It may not have any impact on EB3 this year...but once the EB2 is cleared it will have an impact on EB3; may be in a year or two.

Yes ndialani,i waited for 6 month which i did because i don't know I140 premium started from June 2009(For most the cases).They started in Feb 2009 but its applicable to some limited cases).
May be i would have moved it to premium if i knew in June.Some of the options which i would have tried during that 6 months period was InfoPass,Senator,Ombudsman etc but wasn't very serious about 140 as i thought it may take some years for gc(since the dates very moving very slowly at that time).

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

This trend chart/volume chart certainly represents both family and employment base applications. Following is my thought process now with keeping both trend chart and teh worksheet in this thread chain together.
(1) In Worksheet USCIS claims total EB pending case 233816 by December 2009. Yet we
have not reached to December 2009. Trend chart claims total pending 279031
including family base applications. Since famaily to EB ratio is unknown I would
consider worksheet's figure as authentic for pending EB based 485 cases. One practical
clue for inclining to do this as I know USCIS has approved tons of green card in
parental family category. Many of my friends have got GCs for their parents in a
relatively very small time frame - 1 year
(2) I remember somehow that out of 775000 485 applications in October 2007, there were
around 300000 application were from EB category based on USCIS's published
notification ( I tried to find it on internet but some how I do not see it now). If
somebody has a more solid proof this stats from which we can derive nearly accurate
ratio we may consider those stats. But as I mentioned in point 1 USCIS seems to have
cleared more family bassed 485 with comparison to EB categories I would just
assume for now that 60% preadjudicated cases and "awaiting customer action"
and "New receipts" are from family category and 40 % are from EB category. Total
preadjudicated cases per trend chart is 178418. 40% of that around 71367 - for the
sake of easiness let's make it 71500. This way "awaiting cutomer action" cases for EB
categories could be around 18-19000. "New receipt" cases could be around 18000
roughly.
3) Now total EB based 485 cases by July 2009 could be = Pending cases + preadjudicated
cases + cases awaiting customer action + new receipts = 233816 + 71500 + 18000 +
18000 = 341316. Just the sake for simplicity in assumption we may consider total EB
based 485 workload with USCIS around 350000.
4) "In general" the first lot who will come out from this gutter is "preadjudicated" then the
lot "awaiting customer action" then the "pending ones" and then " new receipts"
Now based on my talk with USCIS guy I can state that USCIS generated RFEs innear past for many cases as apart of preadjudication process, particualrly for may AAC21 usage related cases - Asking for proof of employment in the same job classification. According to that talk if USCIS gets required response to the RFE then USCIS settle that case in a "preadjudicated" shelf. In other words the AC21 guys who got the RFE - responded and case is resumed - most of them should be on "preadjudicted" shelf. Folks,

husband files for himself - I 485

If one of the apps are approved, the other can Join.
No risks....
yes, this sames to be the safest option. only catch seems to be:
- if you are on EAD, then you how do you join? your EAD is based off your I485, which u are presumably abandoning so you can join the other application.

1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
2. If they have earned full 40 points in Social Security
3. If they have paid the tax continuously for 10 years
4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
and
5. If they do not have any criminal records in these 10 years.
You know some people meet all these conditions with the exception of approved i-40 and don't even have a pending Green Card application because their employers are just waiting for their H1 to be used up and then "kick them out".
I think if you meet all the conditions enumerated above, u should be automatically given a Green Card.

Enjoy greenhood..........no luck yet for my wife...But she got a call from USCIS office of Wash DC that it is the biometrics that is holding her approval...they are issuing a biometrics appointment....I told so far she had been issued Biometrics appointment thrice and we have not received anything.
Also if I got approved without biom availability how come she is not....she is giving crap that our job is approving the primary applicant....I told her that none of my friends have got approval just for the principal they all got approved together.
I told her Biom does not hold approval ...she was adamant we can't approve her w/o that.

I didn't get an email but got an sms from USCIS about the case status change to Decision. Here's the update :)
Decision
On October 13, 2009, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
Does that mean an 'Approval'. Between we moved to AZ from FL this week and I'm sending my AR-11 and changed the address over the phone. Is there anything else I need to do ?

Good suggestion, I didn't ask about EAD, I will check next time. But I guess evantually EAD would be revoked after I485 is denied. I think H1 is a backup plan if MTR denied and till appeal is decided..

I don't think so EB2 will make any difference.Its the matter of when they lay their hands on your packet and open it.
Also I have a friend 2nd July Filer filed from NSC and got transferred to TSC , he received his receipts last week and good thing was after two days he had EAD cards sitting in his mailbox too.
The TSC maybe slow in opening the packages but they are fast in sending FPs and EADs.
So hang in there and hopefully you get everything soon.

We should support, as it puts end to consulting companies abuse.
I dont beleive this people are supporting this idea. This will put an end to H1B hiring by small tech startups.
There are better ways to avoid fraud, eg. by depending on paystubs etc...

1 - i have previously applied but was returned due to pd not current , what to file in the form where it say if u have appllied before ? ( i am filing on my own this time )
2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN

Finally, we got the approval emails for self & wife.
I had got an email from TSC.Ncscfollowup@dhs.gov last friday (09/17/2010) with the update below-
1: The review was complete
2: Visa numbers were requested 2 months ago and all security/prints are current
3: Files have been forwarded to officers for completion.
In my case the email to SCOPSSCATA@dhs.gov helped a lot. They in turn sent an email to TSC.Ncscfollowup@dhs.gov to step up the processing.
As others have mentioned IV has played a big part throughout this journey. Thank you again.
